I agree to the following conditions of participating in the 2023 5km (and 2.5km) Santa Run on Sunday 17 December, 2023.
These terms and conditions are subject to change from time to time at the discretion of Kao Kreative Pty Ltd.
The term 'Event Organisers' includes Kao Kreative Pty Ltd.
The term 'Event' includes the event distances 5km and kids (U12) 2.5km races and any other activities as organised by Kao Kreative.
I acknowledge that:
* If I am under the age of 18 this waiver has been accepted by my parent or Guardian and further mention of I refers to both the participant and their parent or guardian.
* I will participate in this event at my own risk and that I am physically fit to be able to participate in the distance I have entered. To the best of my knowledge I am not suffering from any condition which may cause me injury or death during or as a consequence of participation in the Event.
* I understand that participation in the event involves physical exertion and risks associated with it include but are not limited to the effects of heat or cold and dehydration and exhaustion.
* I accept all responsibility for travel and medical insurance and any expenses that occur.
* I understand and will comply with the age restrictions at this event. Age is determined by the age I turn as at 17 December 2023.
There are no age restrictions but children under 5 must be registered along with a registered adult.
* I understand that I am required to wear the official race bib that corresponds to my name and must be attached to the front of my clothing throughout the entire race.
* I am responsible for all personal belongings I bring to the event and the Event Organisers accept no responsibility for loss or damages to these belongings.
* I consent to any identity verification check and other security checks such as baggage checks of personal property prior or during my time at the Event location.
* I will comply with all the by laws and rules of the Australian Sports Anti Doping Authority (ASADA) as outlined in https://www.asada.gov.au/rules-and-violations and Athletics Australia and Athletics New South Wales.
* I have not knowingly used any substance for the purpose of enhancing my performance at the Event and will not use any substance or procedures prohibited by the rules of Athletics New South Wales and Athletics Australia.
* I understand that the event takes place on a Golf Course, and will include grass and pavement and I will follow the approved course and will respect all other users on the course.
* I will comply with all reasonable directions and decisions of the event officials and other authorised representatives involved with this event.
* I understand that bicycles, skateboards (or any other board), baby joggers, strollers, prams, roller or inline skates, motorised boards are not allowed in the event due to safety concerns and I will abide by this guideline. Baby joggers and approved prams are permitted in the 5km event where adult and child must both be registered and each wearing a racing bib.
* ​I acknowledge that dogs are not allowed at the event.
* I agree to show respect for other participants in the event and act with a positive attitude towards the event.
* If using a promotional code it may only be used where the participant meets the conditions applying to the code and uses it within the validity period. Kao Kreative may remove or cancel promotional codes at any time.
* I release The Links Shell Cove, Shellharbour City Council (and their directors, officers, employees, volunteers, contractors, sponsors and / or agents) and Kao Kreative and their contractors and sponsors from any claim and from any liability (to the extent permitted by law) for or as a result of any loss, injury or damage suffered by me in relation to my attendance and participation at the Event
* Including but not limited to falls, trips, contact with other participants, the effects of weather, traffic and conditions of the road and footpaths. How so ever caused, including any claim or liability which arises due to any negligence of Kao Kreative (and / or their directors, officers, employees, volunteers, contractors, sponsors and / or agents). This includes death.
* I consent to receiving emergency medical treatment or preventative treatment as deemed by the Event Medical Team in the event of injury or illness throughout the Event. If transportation to the hospital is required it will be supplied by NSW Ambulance and the cost will be incurred by the participant.
* I consent to the publication and/or use in any form of media whatsoever of my name, race result, image, voice, statement or otherwise, including the publication of my name and/or event result and applicable age bracket in /or marketing materials/website/social media without payment or compensation.
* I further consent to receiving information (including via email) about other events and special offers or promotions.
* The Event Organisers reserve the right to change or modify the Event including the schedule times from time to time without personal notice to the participant. Details of any changes will be provided on the Events website, Social media accounts and Participant guide.
* Entry fees do not include third party registration and payment facilitators. Therefore additional registration and merchant fees will apply and be added to the entry fees on checkout.
Cancellation Policy:
The event will only be cancelled for safety concerns or otherwise as a result of something beyond the Event Organisers control including but not limited to severe weather, pollution, lightning, accident or any other Act of God. Any payment of fees relating to the Event is non-refundable.
Details of any cancellations will be provided on the Events website or Social media accounts.
No claim may be made against the Event Organisers for any loss or damages due to the cancellation of the event.
Refund Policy:
All requests must be received via email and can be made at via info@runshellharbour.com.au.
Please observe the refund guidelines below:
* More than 8 weeks before the event, 75% of entry will be refunded.
* More than 4 weeks to 7 weeks before the event, 50% of entry will be refunded.
* 4 weeks prior, unfortunately no entry fee is refundable.
* No refunds are allowed on the day of the event.
It is not possible to transfer your entry to another participant including the team and relay categories.
We are sorry but we are unable to offer credits to transfer to other participants.
There is no option for full refund even with a medical certificate.
