Event Terms and Conditions

   I, the participant, hereby acknowledge and accept full responsibility for the inherent risks associated with my participation in the Toowoon Bay Ocean Swim.

2.     I understand that these risks may include, but are not limited to, injury or death resulting from overexertion, dehydration, accidents involving other participants or marine life, and adverse weather or ocean conditions.

3.     I agree to release and hold harmless the organising association, its members from any and all liability for any injuries, damages, or losses sustained by me as a result of my participation in this event, whether caused by negligence or otherwise. I understand that this release includes, but is not limited to, any claims for personal injury (including permanent injury) or loss of life.

4.     I consent to receiving any medical treatment that event medical officers deems appropriate during or following the event.  I acknowledge that the event medical officers have the ultimate and final authority to remove a participant from the swim if judged to be physically incapable of continuing without the risk of serious injury.

5.     I affirm that I am physically capable of completing the event and acknowledge that it is my responsibility to assess my own health and abilities. I understand that the event medical staff have the authority to remove participants from the event if they deem it necessary for safety.

6.     I acknowledge that registration fees are non-refundable and non-transferable.

7.     I understand that if I am unable to participate or if the event is cancelled due to inclement weather, dangerous sea conditions, or other "Acts of God," there will be no recourse against the organising association for any losses incurred.

8.     I agree to abide by all event terms and conditions.

9.     I am responsible for the security of my personal belongings.

10.  I acknowledge and accept that safety precautions undertaken by event organisers, such as course supervision by marshals and race safety briefings, are a service to me and other participants, but are not a guarantee of safety. 

11.  I agree to abide by all event rules and directions issued by the event organisers.

12.  I understand that if any cancellation is made due to unsafe conditions the cancellation is a directive of the event referee, The Toowoon Bay SLSC Patrol Captain or Surf Life Saving Central Coast Branch, and these directives are strictly adhered to by the organising committee.

13.  By participating in the event, I consent to the use of any images taken by the event photographer in future promotional materials.

14.  I certify that I am 18 years of age or older, or that I am a parent or legal guardian of a participant under 18 years of age. If I am agreeing/signing on behalf of a minor, I agree to these terms and conditions for and on behalf of the minor participant.

15.  I have read and fully understood the event terms and conditions, including the risk warning provided under Section 5M of the Civil Liability Act 2002, which alerts and cautions participants of potential harm arising from inadequate physical condition, hazardous conditions, and various other risks. By agreeing to this waiver, I acknowledge that I do so voluntarily and with full knowledge of the inherent risks, and I accept these terms.

RISK WARNING (Section 5M Civil Liability Act 2002)

Warning is given to all participants in the Toowoon Bay Ocean Swim that there is a risk of harm to their person and/or property arising from any inadequacy of physical condition or stamina to complete the swim, hazardous sea and beach conditions including sea currents and waves, and the presence of sea craft and sea creatures and other hazards.  The onus is on the participant for the correctness of his/her/their information supplied.

NB: The organiser of this event is Toowoon Bay Ocean Swim Inc.  Your online entry is accepted on behalf of Toowoon Bay Ocean Swim Inc. You accept that your entry is not refundable in the event of cancellation or postponement due to conditions on swim day.
